Leawood, KS – February 17, 2022: The State of New Jersey has approved Assembly Bill 802 (A802) requiring certain retailers to provide training to employees on how to identify and respond to gift card fraud. A802 was introduced on January 14, 2020 and approved on January 18, 2022. The bill is set to take effect on “the first day of the fourth month after enactment,” thus setting an effective date on May 1, 2022.
Pursuant to A802, “every retail mercantile establishment in this State that displays gift cards for sale shall train employees on how to identify and respond to gift card fraud.” As defined in A802, “retail mercantile establishment” means any place of business where merchandise is exposed or offered for sale at retail to members of the consuming public.
Employee training concerning the detection and prevention of gift card fraud shall be conducted in accordance with guidelines to be established by the Director of the Division of Consumer Affairs in the Department of Law and Public Safety, and the New Jersey Attorney General. According to A802, the guidelines shall include: (1) information raising public awareness of the prevalence of gift card fraud; (2) information concerning common gift card fraud schemes; and (3) best practices for retail mercantile establishments to prevent gift card fraud. The guidelines shall be published on the Internet websites of the Department of Law and Public Safety and the Division of Consumer Affairs, and updated periodically, as necessary. As of the posting of this CARD Alert, no information has been released regarding these guidelines.
Any retail mercantile establishment that violates the provisions of this bill shall be subject to a civil penalty of $1,000.
