Leawood, Kan. – July 24, 2026: Recall that just last week we announced that the Arizona Legislature enacted Senate Bill 1366 (“SB 1366”) that amended the Arizona Unclaimed Property Law to remove the section that specifically exempts certain types of properties, including gift cards, from escheat. S.B. 1336, 57th Leg., 2nd Reg. Sess. (Ariz. 2026). To view that Card Alert click here, July 17, 2026 Arizona Card Alert. We have now been informed that the Governor’s Office has issued a statement that striking the property exemptions in Senate Bill 1366 was an error.
The Governor’s Office has apologized for the error and stated they are working on a solution. Due to the Legislative Calendar, they are unable to amend SB 1366 to remediate the error in this session, but the Governor’s Office stated they are committed to reversing this strike through as a technical correction at their first opportunity in the 2027 Legislative Session.
We also anticipate that the Department of Revenue will be issuing formal guidance to confirm that no reporting will be required in November of 2026.
Card Compliant will continue to monitor for any additional updates on the rectification to SB 1366, as it pertains to the exemptions of the Arizona Unclaimed Property Law.
